HSMB Decisions, 2018-2019

HSMB Decision #1

On October 30, 2018, The Harassment and Sexual Misconduct Board (HSMB) met to consider an allegation against a Group and two individual undergraduate students of Sexual Harassment and Sexual Discrimination.  The Respondents did not contest responsibility.

The panel issued sanctions against the individuals of 50 hours of Community Service and Loss of Privileges. Loss of Privileges included suspension from Group social events for the current academic term and a ban from officer positions in Group for remainder of time at W&L.

The panel issued sanctions against the Group of Loss of Privileges and Educational Requirements. The specific sanctions required an apology, new Group policies and protocols, training requirements for Group members, and Social Probation through the first week of Winter Term.


HSMB Decision #2

On April 24, 2019, The Harassment and Sexual Misconduct Board (HSMB) met to consider an allegation against an undergraduate student of Nonconsensual Sexual Contact.  The Respondent admitted responsibility.

The panel issued the following sanctions:

  • Suspension for Spring Term 2019, with conditions to apply for reinstatement
  • Loss of Privileges, which includes the following loss of privileges:
    • Requirement that the student enter into a behavioral agreement and agree to the following: (1) to abstain from alcohol and drug use at all times; (2) violations of any of the University's alcohol, drug, or other policies will result in dismissal; (3) disaffiliation from social organization
    • Housing restrictions
    • The student is precluded from attending any social gatherings, on or off campus, where 10 or more individuals are present and where alcohol is being offered, served, or consumed by any individuals present
    • Student is precluded from attending any W&L events, mixers, formals, athletic events, concerts, and other speakers or performances not required for academic credit other than the following: (1) Washingtonian Society events and meetings; and (2) official University sponsored events related to undergraduate graduation for the year that the student graduates, which events are set forth on the Schedule of Commencement Events
    • A no contact directive forbidding contact with the reporting student and requiring the student to make all reasonable efforts to avoid being in the same room as the reporting student
    • Any violation of the terms of the sanctions will result in dismissal


HSMB Decision #3

On May 15, 2019, the Harassment and Sexual Misconduct Board (HSMB) met to consider a claim against an undergraduate student of nonconsensual sexual penetration and a counterclaim against an undergraduate student for retaliation. The HSMB found the evidence insufficient to show a policy violation for both claims.
