Decisions 2005-2006

UBA Appeal, 1

A fraternity appealed an IFC ruling related to a "dry rush violation" on the grounds that the penalty of a "first strike" was unduly harsh. Outcome: ruled in favor of the IFC and encouraged student leadership to run their organizations with both an understanding of the "letter and spirit of the law" as outlined in the IFC Constitution. The UBA decision was unanimous.

UBA Appeal, 2

The University appealed a Student Judicial Council decision based on insufficient penalty related to a not guilty verdict for a student who had received a formal sanction by the local courts. To not impose an infraction by the University is in direct contradiction with University policy. Outcome: ruled in favor of the University; the student must receive a sanction by the Student Judicial Council based on the University Initiatives on Substance Abuse (2001). The UBA decision was unanimous.

UBA Appeal, 3

The University appealed a Student Judicial Council based on new information for a not guilty verdict for a student charged with conduct unbecoming of a Washington and Lee University related to off-campus behavior. The Student Judicial Council did not have the arrest report at the time of their verdict and relied solely on student testimony. Student testimony did not appear to accurately reflect what was contained in the police report. Outcome: ruled in favor of the University. The Student Judicial Council verdict was overturned. The UBA decision was unanimous.

UBA Appeal, 4

The University appealed a Student Judicial Council verdict based on insufficient penalty. A student who was convicted on Driving Under the Influence of Alcohol with a Blood Alcohol Content of .17 was not suspended by the SJC in accordance with recommendations of the University Initiatives on Substance Abuse (2001). Outcome: ruled in favor of the University. The UBA suspended the student. The UBA decision was unanimous.
