Decisions, 2008-2009

On May 12, 2009, the Student-Faculty Hearing Board met to hear an alleged violation of sexual misconduct for a law student. The alleged violation was brought by an undergraduate student of Washington & Lee and was referred to the SFHB through the Office of the Dean of Students.

It was alleged that at a fraternity party the law student forced an undergraduate student to have sexual intercourse against her will. The SFHB, by a vote of 5 to 3, found the respondent not responsible for this allegation of sexual misconduct. However, the respondent was found responsible for the following misconduct: the respondent exploited the level of petitioner's intoxication for the purpose of a sexual encounter that was physically and emotionally abusive.

We impose the following sanction: the respondent is instructed to complete 150 hours of community service, with an agency that provides services for distressed women. The choice(s) of agencies within this category much be approved by Dean Evans and Professor Anderson (faculty chair of the SFHB). Successful fulfillment of the community service will conclude the internal judicial proceeding at Washington and Lee.

In the finding of responsibility for the misconduct, and in the sanction, the SFHB was unanimous.

The SFHB's decisions were announced to petitioner and respondent at approximately 7:00 P.M. on May 13, at which time the hearing was adjourned.
