Policy Regarding Solicitation/Sale of Goods and Services at Washington and Lee University

Introduction

Policy Statement

This policy sets rules for the solicitation and sale of goods and services on campus at Washington and Lee University ("W&L" or "the University") and on non-campus property owned or operated by W&L.

Applicability

This policy applies to any individual or group attempting to solicit or sell goods or services on any part of the campus of W&L or on non-campus property owned or operated by W&L.  It also applies to any individual or group attempting to use a W&L student to solicit or sell goods or services on any part of the W&L campus or on non-campus property owned or operated by W&L.  This policy does not apply to contracted vendors or departments or divisions of the University.

Policy

W&L prohibits for-profit organizations, for-profit individuals, and student organizations that have not been officially recognized by the University from soliciting or selling goods or services on campus or on non-campus property owned or operated by W&L to any individual, including, but not limited to, W&L students, staff, and faculty, and from using a W&L student to do so, unless the solicitation or sale satisfies the following conditions: 

  1. University Approval.  If a good or service for the benefit of students, staff, or faculty is recognized and not in conflict with University providers, upon the approval of the University Store Director, the Assistant Director of Student Activities may approve an on-campus sale in a specified location on a specified date and at a specified time.
  2. Standard Commission is Paid to the UniversityA standard commission of 25 percent of gross sales must be paid to the general revenues of the University.  Sales by approved outside vendors will be processed through the University Store registers.  Only the Vice President for Finance/Treasurer may approve deviations from this standard.
  3. Approved LocationThe only approved locations for such solicitations or sales are inside the Elrod Commons (coordinated with the Assistant Director of Student Activities) and at the University Store (coordinated with the University Store Director).  In extraordinary circumstances, a deviation may be granted by the Vice President for Finance/Treasurer (e.g. Community Festival, Student Flea Market).
  4. Compliance with Applicable LawsThe University requires that each approved vendor meet the applicable requirements of the City of Lexington ordinances regarding peddling and soliciting and will comply with regulations regarding appropriate state and local sales taxes.

All solicitations or sales on campus or on non-campus property owned or operated by W&L by student organizations that have been officially recognized by the University must be registered with the Assistant Director of Student Activities.

All solicitations or sales on campus by approved individuals or entities must conform to reasonable standards of good taste as determined by the Assistant Director of Student Activities (e.g., no alcohol promotion or offensive or suggestive wording).  Individuals and organizations that are permitted to solicit or sell goods or services on campus or on non-campus property owned or operated by W&L under this policy are fully responsible for transporting their own goods to and from the specified location, for cleaning the area used for solicitations or sales, and for providing an accounting of gross receipts.

December 20, 2013 -- Revised policy to clarify its application to recognized and non-recognized student organizations, to exclude contracted vendors and departments or divisions of the University, to reflect recent changes in referenced positions, to address solicitations and sales on non-campus property owned or operated by W&L, and to address the use of W&L students to solicit or sell goods or services.
